3. Scope of Site
3.1 The use of the services of www.pearl-photos.co.uk is subject to the conditions given below. This is a UK company with UK laws. The UK courts alone have jurisdiction in all litigation arising in connection with the utilisation of www.pearl-photos.co.uk .
3.2 The present General Terms and conditions for use of the Services of www.pearl-photos.co.uk are applicable to all services offered by Pearl Photo via the Internet.
3.3 Pearl Photo reserves the right to amend the present Terms and Conditions without notice and to post their contents on its pages.
4. Use of the services
4.1 The user must reply completely and accurately to the form that has to be completed when registering for the services.
4.2 The user shall ensure that his images respect valid laws; specifically the provisions of criminal law concerning pornography, violence and paedophilia, Pearl Photo will report any violation of criminal law. |
5. Price
5.1 The Price of the Goods is set out on the Website and the confirmation of order. The price is in Great Britain Pounds Sterling and includes all taxes or other duties due, including Value Added Tax, charged at the rate or rates applicable at the date of confirmation of order.
5.2 Delivery charges are not included in the price of the Goods. Details of delivery charges can be found in the (Services ) section of this website.
6. Data Confidentiality.
6.1 Pearl Photo undertakes not to communicate personal customer data outside the company.
6.2 The Personal customer data is used to send photos and goods, to contact them about there orders and to inform them about Pearl Photo's offers.
7. Intellectual property.
7.1 The entire contents of the www.pearl-photo.co.uk.com and .co.uk website and of the Photo Service program (text, graphics, and computer) are the property of Pearl Chemist. Any reproduction of the contents, in whole or in part, regardless of the procedure or the medium used, shall require the express prior written authorisation of Pearl Photo
7.2 Image archives transferred for processing to www.pearl-photos.co.uk remain the property of the user.
7.3 The user is deemed the "owner of rights" and thus bears sole responsibility for obtaining intellectual property rights relating to his/her images. Pearl Photo shall incur no responsibility whatsoever for abuse of printed images on the part of the user. Consequently, the user may only order photos from Pearl Photo and uses those images if he has the necessary rights of use.
8. Completing the Contract.
8.1 When you complete your details and the details of the Goods which you wish to purchase and submit them to us by clicking the confirm order button, you are offering to purchase the Goods at the price shown on the Website subject to these terms and conditions.
8.2 The Contract for the sale by us to you of the Goods is completed when we send to you our confirmation of order by email.
8.3 In order to buy Goods from us through this Website you must be at least 18 years old. We reserve the right at our discretion to refuse to complete a contract for the sale of Goods to you.

9. Responsibilities
9.1 Pearl Photo guarantees to do its utmost to ensure availability of the services of www.pearl-photos.co.uk .Temporary Temporary interruptions of the services are, however, possible due to technical or other reasons. Pearl Photo will make every effort to inform its customers as efficiently as possible about the nature and duration of any interruptions, but shall incur no liability whatsoever in the event that its services are unavailable. Similarly, Pearl Photo cannot guarantee the reliability and quality of the Internet outside its own premises.
9.2 Pearl Photo has a high capacity for storage (personal data, images, etc.). This should make it possible to restore stored data, even in the event of a serious fault. However, www.pearl-photos.co.uk shall incur no liability whatsoever in the event of data loss. The user shall keep a safe copy of the transferred files on his/her side. The images files are deleted from www.pearl-photos.co.uk database at the latest 30 days after the processing of the order.
9.3 In the event of loss or damage to data storage medium or slides, the liability of Pearl Photo shall be limited to the replacement of the medium by new material of equivalent quality. | 9.4 Reserves the right not to process images whose contents are contrary to good moral. In this context, Pearl Photo is entitled not process images, even if they respect valid law.
10. Title
10.1 Risk in the Goods shall pass to the Customer on delivery and until title passes to the Customer the Customer shall keep the Company indemnified against all loss or damage to the Goods or depreciation in their value and shall keep them fully insured, and shall not remove the Goods or allow them to be removed from the address to which they are delivered and shall keep them in good condition and complete and shall not allow them to become the subject of any charge or lien, whether by operation of law or otherwise.
10.2 Notwithstanding the earlier passing of risk, title in the Goods shall remain with the Company and shall not pass to the Customer until the amount due under the invoice for them (including interest and costs) has been paid in full.
11. Payment
Payment is accepted by credit ,debit cards or paypal only.
12. Delivery
12.1 Once your order has been confirmed by us and payment completed, your Goods will be despatched to you as soon as possible. In any event, delivery will take place within 30 days, commencing on the day after you have forwarded your order. If for whatever reason the Goods which you have ordered are not available, we will inform you as soon as possible and will provide a full refund of any money paid by you within the same 30 day period.
12.2 Delivery of Goods will be worldwide, however, the Company reserves the right to refuse, at its discretion, to deliver to certain countries. Delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, we will contact you to make an alternative arrangement for delivery.
13. Cancellation of Orders
13.1 Due to the nature of the products You have a right to cancel your order within 24 hours of transmitting order. The 24 hour period begins upon the time the order for your goods is placed. Goods that do not require special processing such as pre packed picture frames have a period of seven days to cancel the order.
13.2 In order to cancel your order, you must notify us by email or telephone on 0208 672 2157 within this 24 hour period. A refund of any monies paid by you to us for the Goods will be made within 30 days of your cancellation. If you have paid for the price of the Goods by credit or debit card, your credit or debit card account will be re-credited as soon as possible and in any event within the above 30 day period.
13.3 If you cancel your order for prepacked goods you must take good care of the Goods and must return them to us at your own expense (by registered post if you live in the UK or if you live outside the UK by a carrier such as Fedex which can track the consignment.
